Terms of Service for the LasKar Mobile Application

1. Publisher and Hosting

1.1 Publisher

The LasKar application is published by KARDINAL, a simplified joint-stock company with share capital of €3,627.70, registered in the Paris Trade and Companies Register under number 809 234 586 (SIRET 809 234 586 00034), whose registered office is at 10 rue de Penthièvre, 75008 Paris, France.

1.2 Hosting and Data

The application relies on the Google Firebase infrastructure (part of Google Cloud Platform) for hosting and managing certain data. Hosting is provided by:

Google Ireland Limited acts as a data processor for KARDINAL SAS under Article 28 of the GDPR. The applicable Data Processing Addendum and the full list of Google Cloud Platform subprocessors can be found here: https://cloud.google.com/terms/data-processing-terms?hl=fr

Only the following data are stored in the cloud:

  • User’s phone number and first name (via Firebase Authentication)
  • Transaction metadata (transaction ID, subscription type, purchase/renewal date) for the Pro plan, via in-app purchases on Google Play and the App Store

All other data—especially your route addresses and favorite addresses—are stored locally on your device and are deleted if you uninstall the app or remove them manually.

2. Definitions

In these Terms of Use:

  • “Application” means the LasKar mobile app.
  • “User” means any professional (independent driver, logistics operator, field salesperson, etc.) using the Application.
  • “Account” means the personal space secured by an identifier (phone number) and an OTP code received by SMS.
  • “Freemium Plan” and “Premium Plan” refer to the two pricing tiers described in Appendix 1.

3. Acceptance, Access, and Account Creation

By downloading or using the Application, you automatically accept these Terms of Use.

3.1 To create an Account, the User enters a valid phone number. A one-time password (OTP) is then sent by SMS to confirm first-time access. This code expires after 5 minutes and can be used only once. After repeated failed attempts, Firebase security policies impose a temporary block.

3.2 Activation is completed via the OTP received by SMS, managed by Firebase Authentication. Account management is handled through Google Firebase Authentication, in accordance with Google’s security and privacy policies. Firebase stores only two data points: the User’s phone number and first name. OTP codes are not retained after authentication. These data benefit from Google’s data-protection measures.

3.3 The User is responsible for keeping their credentials confidential and for all actions performed under their Account.

3.4 KARDINAL undertakes to make the Application as useful and performing as possible. Accordingly, KARDINAL reserves the right to modify the Application or to charge for its services at any time, for any reason. KARDINAL SAS will never bill the Application or its services without clearly informing the User of what they are paying for.

3.5 The Application is intended for professional use only. The User declares they are acting in the context of their professional activity and acknowledges they are not a consumer under the French Consumer Code.

4. Plans and Pricing

4.1 Freemium Plan (free)

  • Up to 3 tours per day, 10 addresses per tour.
  • Features: address entry, route optimisation, navigation hand-off, delivery check-ins, time-slot management, stop-duration settings, address scanning, voice commands, tour duplication, bulk address entry, real-time updates, tour history.

4.2 Pro Plan (€8 excl. VAT/month)

  • Unlimited tours, up to 250 addresses per tour.
  • Features: address entry, route optimisation, navigation hand-off, delivery check-ins, time-slot management, stop-duration settings, address scanning, voice commands, tour duplication, bulk address entry, real-time updates, tour history.
  • 7-day free trial, limited to one trial per User or Company.
  • If the User upgrades to Pro before the trial ends, any remaining trial period is forfeited without refund.
  • Monthly billing via auto-renewing subscription.
  • Subscriptions are managed exclusively through in-app purchases on Google Play and the Apple App Store. To cancel or change your plan, follow the subscription-management procedure of the respective platform.
  • To prevent automatic renewal, disable renewals at least 24 hours before the end of the current period.
  • You may cancel at any time through the platform’s subscription management interface.

5. User Rights and Obligations

5.1 The User agrees to use the Application solely for lawful professional purposes in planning and executing tours.

5.2 The User must not:

  • Copy, modify, translate, adapt, decompile, disassemble, extract source code, or create derivative works of the Application, its components, or its trademarks;
  • Perform reverse-engineering, scraping, or circumvent security measures;
  • Jailbreak or root their device. KARDINAL SAS is not liable for any vulnerabilities or malfunctions resulting therefrom.

5.3 Some features (mapping, traffic, updates) require an Internet connection. The User is solely responsible for their data subscriptions and any associated charges (including roaming and overage fees).

5.4 The User must ensure their device remains powered and available. KARDINAL SAS is not liable if the Application cannot be used because the device is turned off or out of battery.

6. Intellectual Property

The Application, its source code, interfaces, and all related trademarks and logos (including “LasKar”) are the exclusive property of KARDINAL SAS.

KARDINAL SAS grants the User a non-exclusive, non-transferable license for personal and professional use only, subject to these Terms.

7. Personal Data

7.1 Data Controller: KARDINAL SAS.

7.3 The types of data collected, purposes, retention periods, and User rights are described in that policy.

8. Liability and Warranties

8.1 KARDINAL SAS strives to ensure the Application’s availability and performance but does not guarantee absolute accuracy for estimated times of arrival (ETAs) or navigation.

8.2 ETA calculations are performed by the HERE Technologies engine. Navigation is provided by Google Maps, Waze, or Here WeGo at the User’s choice. KARDINAL SAS is not liable for any inaccuracies, delays, disconnections, or errors in these third-party services, nor for any resulting direct or indirect damages.

8.3 Under no circumstances shall KARDINAL SAS be liable for indirect damages, loss of revenue, data loss, or any intangible losses.

The total liability of KARDINAL SAS, for any cause, shall not exceed the amount paid by the User over the preceding 12 months.

9. Changes to the Terms

9.1 KARDINAL SAS reserves the right to modify these Terms at any time. Users will be informed at least 15 days before the new version takes effect, upon their next login, and must accept the new Terms to continue using the Application.

10. Application Updates

10.1 The User agrees to accept all updates offered through the app stores (Android/iOS).

10.2 KARDINAL SAS may suspend, interrupt, or terminate access to the Application at any time, without notice or compensation. Updates will not materially alter core features without clear prior notice to the User and, if paid or essential features are added or changed, explicit consent will be obtained.

10.3 To continue using the Application, the User must install the latest version.

10.4 KARDINAL SAS does not guarantee ongoing compatibility with every Android or iOS version.

11. Suspension, Termination, and Removal

11.1 For serious breaches of these Terms (non-payment, fraudulent use, etc.), KARDINAL SAS may suspend or terminate the User’s access after a failed formal notice.

11.2 Upon termination, all granted rights and licenses end immediately. The User must stop all use and uninstall the Application.

11.3 No refunds will be issued for subscription periods in progress at the time of termination.

Exception: If the platform is unavailable for more than 7 consecutive days or a major malfunction prevents normal use, the User may request a prorated credit or refund for the affected period.

12. Governing Law and Dispute Resolution

12.1 These Terms are governed by French law.

12.2 Any dispute concerning their interpretation, execution, or validity shall be subject to the exclusive jurisdiction of the courts of Paris, France.

12.3 However, if a mandatory provision of law in the User’s professional place of residence prohibits an exclusive jurisdiction clause in favor of a foreign court, the User may bring proceedings before their local court without affecting the clause’s validity for other Users.
